Petock & Petock, LLC handles zoning applications seeking variances from municipal zoning ordinances before local zoning boards and appeals from decisions of zoning boards before the Court of Common Pleas. The firm also represents clients opposing the granting of applications for variances. In order for an applicant to be granted a variance it ordinarily must be shown that the ordinance from which variance relief is sought creates an undue hardship on the applicant. A zoning board will consider several factors in rendering a determination as to whether to grant a variance including, for example, whether there are unique physical characteristics or conditions peculiar to the particular property, whether the undue hardship was created by the applicant and that the variance if authorized will not alter the essential character of the neighborhood.
